These Terms and Conditions (“Terms”) govern your access to and use of learn.highspitality.com and the courses, certifications, and related services offered by Highspitality (“Highspitality,” “we,” “us”) (together, the “Service”).

By creating an account, purchasing a course, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Last updated: 8.1.2026

1. Eligibility and Age Restriction

You must be at least 21 years old to create an account or purchase a course. By using the Service, you represent that you meet this requirement.

The Service is intended for hospitality professionals (bartenders, servers, managers, and related staff) working at, or preparing to work at, licensed venues.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate, current information when registering, and notify us promptly if you believe your account has been accessed without authorization.

3. Courses, Certifications, and Services

Highspitality provides online training courses and issues certificates of completion upon successfully finishing a course. Course availability, content, and pricing may change over time; the price and content in effect at the time of your order will apply to that order.

Certification is educational and reflects completion of Highspitality's training program. It does not itself constitute legal authorization to serve THC beverages, and does not replace any license, permit, or training required by state or local law. You are solely responsible for confirming what certifications, licenses, or permits your jurisdiction and employer require.

4. Payment and Billing

All fees are due at the time of purchase unless otherwise stated. Prices are listed in USD and may include applicable taxes. Payment is processed by our third-party payment processor; Highspitality does not store your full card details.

5. Refunds and Cancellations

Refunds and cancellations are governed by our Refund Policy at learn.highspitality.com/refund-policy, which is incorporated into these Terms by reference.

6. Intellectual Property

All course content, text, video, graphics, logos, and materials on the Service are owned by Highspitality or its licensors and are protected by copyright and other intellectual property laws. You may not copy, distribute, resell, or publicly share course materials without our prior written permission.

7. Acceptable Use

You agree not to: share your account or course access with others; upload unlawful, abusive, or infringing content; attempt to reverse-engineer or scrape the Service; or use the Service for any purpose other than your own professional training.

8. Third-Party Links

The Service may contain links to third-party websites. We do not control and are not responsible for the content or practices of those sites.

9. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee that the Service will be uninterrupted, error-free, or that completing a course will result in any particular employment, licensing, or legal outcome. Nothing on the Service constitutes legal, regulatory, or compliance advice.

10. Limitation of Liability

To the maximum extent permitted by law, Highspitality's total liability arising from your use of the Service will not exceed the amount you paid to Highspitality in the twelve (12) months preceding the claim. Highspitality is not liable for indirect, incidental, or consequential damages.

11. Privacy

Use of the Service is also governed by our Privacy Policy at learn.highspitality.com/privacy, incorporated into these Terms by reference.

12. Termination

We may suspend or terminate your account for violation of these Terms. You may stop using the Service at any time; certification already issued is not revoked by account closure unless earned in violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Cancellation of Orders and Services

Highspitality courses are digital training products delivered instantly upon purchase. By completing your purchase, you acknowledge that you are receiving immediate access to digital course content. Refund and cancellation eligibility is governed by our Refund Policy at learn.highspitality.com/refund-policy.

15. Governing Law

These Terms are governed by the laws of the State of Nevada without regard to conflict-of-law principles, and any disputes will be resolved in the state or federal courts located in Clark County, Nevada.

16. Contact

Questions about these Terms can be sent to help@highspitality.com or through learn.highspitality.com/contact.
